These Terms of Service ("Terms") govern your access to and use of the Vid+ mobile application (the "App") and all related features, content, and services (collectively, the "Services"), provided by Vid+ ("we," "us," or "our").
By downloading, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using the Services. Your use of the Services is also subject to our Privacy Policy.
By using Vid+, you represent and warrant that:
• Age Requirement: You are at least 18 years of age (or the age of legal majority in your jurisdiction).
• Legal Authority: You have the full right, power, and authority to enter into this agreement.
• Compliance: You are not a person barred from receiving services under the laws of any applicable jurisdiction.
• Accuracy: All information you provide (e.g., during registration) is true, accurate, and complete, and you will update it as needed.
• Lawful Use: You will not use the Services for any illegal or unauthorized purpose, and your use will comply with all applicable laws and regulations.
• No Automation: You will not use automated systems (e.g., bots, scripts) to access the Services.
We reserve the right to suspend or terminate your access if you provide false information or violate these Terms.
Subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to:
• (a) Download and install the App on personal devices that you own or control; and
• (b) Use the Services for your personal, non-commercial purposes.
All rights, title, and interest in the Services, including all software, code, designs, text, graphics, logos, trademarks, and other materials ("Our Content") are and will remain our exclusive property or that of our licensors. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services or Our Content for commercial purposes without our prior written consent.
• Ownership: You retain ownership of the videos, images, and other content you create, upload, or generate using the App ("User Content").
• License to Us: By submitting User Content, you grant us a worldwide, royalty-free license to host, store, reproduce, modify, and communicate your User Content solely for the purpose of operating, providing, and improving the Services to you.
• Responsibility: You are solely responsible for your User Content and ensure it does not infringe on any third-party rights or violate any law. We reserve the right to remove any User Content we believe violates these Terms.
You agree not to use the Services to:
• Violate any law or engage in fraudulent activity.
• Harass, abuse, or harm others.
• Post or share content that is illegal, defamatory, obscene, threatening, hateful, or discriminatory.
• Create, upload, or distribute deepfakes or any synthetic media intended to mislead or harm.
• Attempt to circumvent the security or integrity of the Services.
• Disparage us or use the Services to build a competing product.
• Use the Services for any commercial endeavor without our authorization.
Vid+ may offer access to certain features via paid subscription plans ("Subscriptions").
• Fees and Billing: Subscription fees are billed in advance, are generally non-refundable, and may vary by region. We reserve the right to correct pricing errors and modify subscription fees.
• Auto-Renewal: Unless you cancel before the end of the current billing cycle, Subscriptions will automatically renew. You are responsible for managing your subscription and turning off auto-renewal through your device's app store (e.g., Apple App Store, Google Play Store) settings.
• Cancellation: Canceling a Subscription stops future charges but does not trigger a refund for the current period. You can cancel at any time through your app store account settings.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services.
You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
These Terms remain effective while you use the Services. We may suspend or terminate your access at any time, for any reason, including for breach of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes arising from these Terms.
We may update these Terms periodically. We will notify you of material changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use after changes take effect constitutes acceptance of the revised Terms.
